Our Mediation Process

Pre-Mediation Session

Before the mediation session begins, our firm provides comprehensive guidance to ensure that all participants are well-prepared and the process proceeds efficiently. Preparation is key to a productive session and significantly increases the likelihood of a successful resolution.

Attorneys are encouraged to submit Confidential Mediation Summaries in advance through email. These summaries allow the mediator to gain a deeper understanding of each party's position, factual background, and settlement posture while maintaining strict confidentiality. Supporting exhibits, photographs, expert reports, or relevant correspondence may also be uploaded securely for pre-session review.

This proactive approach ensures that the mediator is fully informed before the first session begins, enabling a more focused, efficient, and productive mediation process for all involved.

The Mediation Session

On the day of mediation, Strauss Mediation provides a neutral and professional environment designed to promote constructive dialogue and fair resolution.

The session begins with opening remarks by David Strauss, who outlines the process, confirms confidentiality, and sets clear ground rules. Each party is then given an opportunity to present their perspective in a respectful setting, allowing the mediator to understand the issues and priorities at hand before moving into private discussions.
Throughout the process, we facilitate communication, clarify points of contention, and encourage creative problem-solving.

This structure helps maintain transparency, focus, and momentum toward agreement while ensuring that all participants feel heard and respected.

Post-Mediation Resolution

At the conclusion of the mediation, if the parties reach a full or partial settlement, the terms of the agreement are promptly documented and reviewed to ensure accuracy and mutual understanding. The written agreement is then signed by all parties and, when appropriate, incorporated into a court order or stipulation. This immediate documentation helps solidify the resolution, prevent future misunderstandings, and provide a clear roadmap for enforcement or compliance.

In cases where mediation does not result in a complete agreement, Strauss Mediation will prepare and submit a Confidential Mediator's Report to the court in accordance with Florida mediation rules. This report only confirms whether an agreement was reached. All discussions that occur during mediation remain strictly protected under Florida's confidentiality provisions, preserving the integrity of the process and the privacy of the participants.

We focus, successful or not, on closure, clarity, and compliance. We ensure that all parties leave the process with a full understanding of their options, next steps, and obligations.
